1. Acceptance of these terms
By creating an account or using Lumi (the "Service"), you agree to these Terms of Service. If you do not agree, you may not use the Service. These terms form a binding agreement between you and [TODO: legal entity name].
2. Description of the Service
Lumi provides an AI-powered tutoring assistant that helps learners with curriculum-related questions. The tutor is designed to stay on topic and focus on educational content. The Service is a study aid only and is not a substitute for professional, medical, legal, or formal educational advice, nor for instruction by a qualified teacher.
3. Eligibility & parental responsibility
The Service is intended for minors as a learning tool. A parent or legal guardian must agree to these terms on the minor's behalf, set up and supervise the account, and remains responsible for the minor's use of the Service and for any charges incurred.
[TODO: confirm minimum age and consent requirements with counsel.]
4. Accounts
You are responsible for keeping your account credentials confidential and for all activity under your account. You agree to provide accurate information and to notify us promptly of any unauthorised use.
5. Subscriptions & free trial
We offer a 7-day free trial that includes a capped allowance of usage tokens. After the trial, continued access requires a paid subscription:
- Monthly plan: €9 per month.
- Yearly plan: €79 per year.
Billing is handled by our payment provider Stripe. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. Prices are stated inclusive of applicable taxes where required.
[TODO: confirm token caps, VAT handling, and renewal terms.]
6. Cancellation & refunds
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period and you retain access until then. Consumers in the EU and Germany may additionally have a statutory right of withdrawal (Widerruf) for distance contracts — see our Widerrufsbelehrung for details and important information about how that right may lapse for digital content once the service begins.
[TODO: confirm refund policy beyond the statutory withdrawal right.]
7. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes.
- Attempt to circumvent usage limits, security measures, or the on-topic restrictions of the tutor.
- Submit content that is illegal, infringing, or that you do not have the right to share.
- Reverse engineer, resell, or misuse the Service or its underlying models.
8. AI disclaimer
Responses are generated by an AI model and may be incomplete, inaccurate, or out of date. You should independently verify important information and never rely on the Service as the sole basis for academic or other decisions.
9. Intellectual property
The Service, including its software, branding, and content we provide, is owned by us or our licensors and is protected by intellectual property laws. You retain rights to the content you submit, and grant us a limited licence to process it solely to operate and improve the Service.
10. Limitation of liability
To the extent permitted by law, the Service is provided "as is" without warranties of any kind, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be excluded under applicable law, including liability for intent or gross negligence and for injury to life, body, or health.
11. Governing law
These terms are governed by the laws of [TODO: governing-law jurisdiction], without prejudice to mandatory consumer protection rules of your country of residence. [TODO: confirm jurisdiction and venue with counsel.]
12. Changes
We may update these terms from time to time. We will notify you of material changes, and continued use of the Service after changes take effect constitutes acceptance.
